Terms of Service

These Terms of Service govern the access to and use of PestRouting, including our website, web application, routing optimization software, dashboards, analytics, audits, simulations, integrations, support services and related services.

The PestRouting service is provided by:

By creating an account, accessing the application, booking a demo, using PestRouting, purchasing a subscription, enabling an integration or otherwise using the Service, you agree to these Terms of Service.

If you use PestRouting on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, “Customer”, “you” and “your” refer to that entity.

1. B2B Use Only

PestRouting is intended exclusively for business customers, companies, entrepreneurs and professional users.

By using PestRouting or purchasing access to the Service, you confirm that you act for business or professional purposes and not as a consumer.

Consumer withdrawal rights do not apply where you act as a business customer. Mandatory legal rights remain unaffected.

We may refuse, suspend or terminate access if we reasonably believe that the Service is being used for private consumer purposes, unlawful purposes, abusive behavior or purposes outside the intended business use.

2. The PestRouting Service

PestRouting provides software and related services for route optimization, scheduling analysis, operational planning, field service efficiency analysis, routing audits, simulations, dashboards, analytics and related business insights.

Depending on the selected plan, subscription, checkout, offer or individual agreement, the Service may include:

  • access to the PestRouting web application;
  • routing audits and simulations;
  • dashboard, analytics and insight features;
  • appointment, technician, territory, office and route analysis;
  • FieldRoutes sync and other third-party integrations;
  • recommendations for improved scheduling and routing;
  • automated or semi-automated route optimization;
  • manual consulting, onboarding or implementation support;
  • subscription-based access;
  • usage-based features or usage-based pricing components;
  • support services.

The exact features, limits, usage allowances, pricing, support level and service scope depend on the applicable plan, pricing page, checkout page, subscription, order confirmation or individual agreement.

We may offer free audits, free trials, pilot projects or limited evaluation access. Such free or trial access may be modified, restricted or discontinued at any time.

3. No Guarantee of Perfect Routes or Business Results

PestRouting is an optimization and decision-support tool.

We aim to provide useful, data-driven and commercially valuable routing recommendations. However, we do not guarantee that every route, schedule, recommendation, audit result, simulation, optimization output or automated plan will be complete, error-free, legally compliant, operationally feasible or the best possible result in every situation.

Routing and scheduling decisions may depend on many external factors, including technician availability, customer preferences, service windows, traffic, weather, local rules, operational constraints, incomplete data, outdated data, third-party system limitations, API availability and human decisions.

You remain responsible for reviewing, validating and applying the results before using them in your business operations.

You are responsible for your operational decisions, customer communication, technician assignments, service windows, compliance with applicable labor, traffic, safety and industry rules, and any manual or automated changes you decide to apply.

4. Account Registration and Access

To use certain parts of PestRouting, you may need to create an account or receive access credentials.

You are responsible for:

  • providing accurate and current account information;
  • keeping login credentials secure;
  • restricting access to authorized users only;
  • ensuring that your users comply with these Terms;
  • promptly notifying us of unauthorized access or security incidents.

You may not share access credentials with unauthorized persons or use PestRouting in a way that circumvents plan limits, user limits, usage limits, security controls or payment obligations.

5. Plans, Features and Entitlements

PestRouting may offer different plans, including but not limited to RUN, GROW, SCALE and Enterprise or custom plans.

Plans may differ by included features, number of users, locations, planning horizon, simulation access, simulation horizon, what-if plans, scheduled auto-plans, custom roles, priority compute, support level, onboarding, implementation services, strategic calls, success management, volume allowances and other entitlements.

Feature availability may depend on your selected plan and may change if you upgrade, downgrade, cancel or change your subscription.

Enterprise or custom plans may require a separate commercial agreement or sales process.

6. Pricing, Usage-Based Billing and Metering

PestRouting may be offered through monthly subscriptions, annual subscriptions, fixed-price plans, usage-based pricing components, custom offers, audits, onboarding packages, implementation packages or individual agreements.

Prices, included usage, usage limits, billing intervals, renewal terms, additional charges and applicable discounts are shown on the applicable pricing page, checkout page, subscription page, Paddle checkout, order confirmation or individual agreement.

Usage-based charges may be based on metrics such as planner jobs, simulation jobs, appointment volume, number of offices, number of users, route calculations, optimization runs, imported records, API sync volume, usage allowances, overages or other usage metrics described in the applicable plan or checkout.

Certain plans may include free allowances, starter credits, rollover credits, simulation credits or other promotional usage amounts. Such allowances and credits are not cash, have no cash value, are not transferable, and may expire, roll over or be capped according to the applicable plan rules.

You are responsible for reviewing the applicable pricing, plan details, included usage, overage rates and billing interval before purchasing or using paid features.

7. Annual Billing and Discounts

Where annual billing is offered, annual subscriptions may include a discount compared to monthly billing.

Unless otherwise stated, annual subscriptions are billed upfront through Paddle and remain active until the end of the paid annual term.

Cancellation of an annual subscription prevents future renewal but does not automatically entitle you to a refund for the remaining paid term, unless required by law, approved by Paddle or stated in the applicable Refund Policy.

8. Price Changes

We may change prices, plan structures, included usage, usage-based rates, overage rates, discounts, features or billing models from time to time.

Price changes do not apply retroactively and do not affect fees already incurred.

For existing paid subscriptions, material price changes will generally apply no earlier than the next renewal period or next billing period after notice.

We will make reasonable efforts to provide at least 30 days’ notice before a material price increase applies to an existing subscription.

If you do not agree to a price change, you may cancel your subscription before the change takes effect. Continued use of the Service after the effective date of a price change constitutes acceptance of the updated pricing.

9. Payments via Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for our orders. Paddle provides payment processing, invoicing, applicable tax calculation and collection, billing support, customer payment support, chargeback handling and refunds according to Paddle’s applicable terms and policies.

For purchases processed through Paddle, Paddle issues invoices, receipts and payment confirmations to the customer as Merchant of Record or reseller.

Dayem Solutions UG (haftungsbeschränkt) does not directly invoice customers for purchases processed through Paddle.

Your payment transaction may be subject to Paddle’s buyer terms, checkout terms, refund policy, payment processes and tax processes.

We remain responsible for providing access to PestRouting, product-related support, technical support and service-related communication unless otherwise stated.

If there is a conflict between these Terms and mandatory Paddle buyer terms for the payment transaction, Paddle’s applicable terms may apply to the payment transaction to the extent required.

10. Taxes

Prices may be exclusive or inclusive of applicable taxes depending on the checkout, invoice, jurisdiction and payment setup.

Where Paddle processes the payment as Merchant of Record or reseller, Paddle may calculate, collect and remit applicable taxes according to its own processes and legal obligations.

You are responsible for providing accurate billing, tax and business information, including any valid tax identification number, VAT ID, exemption certificate or other tax documentation where applicable.

11. Subscription Term, Renewal and Cancellation

Subscriptions may be offered on a monthly, annual or custom billing term.

Unless otherwise stated in the applicable checkout, order confirmation or agreement, subscriptions renew automatically at the end of each billing period until cancelled.

You may cancel future renewals through the Paddle customer portal, through the application where available, or by contacting support at support@pestrouting.com.

If you contact support for cancellation, we may assist with cancelling the subscription in Paddle.

Cancellation prevents future renewal but does not automatically entitle you to a refund for the current billing period or already paid term, unless required by law, approved by Paddle or stated in the applicable Refund Policy.

Unless otherwise stated, access continues until the end of the paid billing period. After the paid term ends, access may be restricted, downgraded, suspended or terminated.

12. Refunds

Refunds are governed by Paddle’s applicable buyer terms and refund policy, and by our Refund Policy where applicable.

Unless otherwise stated, paid subscriptions, audits, onboarding fees, implementation fees, custom services and usage-based charges are generally non-refundable once the billing period has started, usage has occurred or the service has been provided.

Refunds may be considered in cases of billing errors, duplicate payments, material technical issues that prevent use of the Service, or where required by law.

Dayem Solutions UG (haftungsbeschränkt) does not provide separate refunds outside Paddle’s refund process for purchases processed through Paddle.

If you believe you are entitled to a refund, please contact Paddle through the payment receipt, Paddle customer portal or Paddle support process, and you may also contact us at support@pestrouting.com so we can help investigate the issue.

13. Free Audits, Demos, Trials and Pilots

We may offer demos, free audits, paid audits, trial access, pilot projects or limited evaluation access.

Trial, demo, audit and pilot access may be limited in time, scope, features, data volume, users or usage.

We may modify, suspend or end trial, demo, audit or pilot access at any time.

Audit results, simulations and recommendations are provided for evaluation and decision-support purposes only and do not guarantee specific savings, revenue improvements, cost reductions, operational outcomes, customer retention, technician utilization, profitability improvements or business results.

14. Customer Data

“Customer Data” means all data, files, records, appointment information, route information, technician information, customer records, addresses, schedules, business information, configuration data, API data, uploaded content and other materials provided to PestRouting by you or on your behalf.

You retain all rights in your Customer Data.

You grant us the rights necessary to process Customer Data for the purpose of providing, securing, maintaining, improving and supporting PestRouting.

You are responsible for ensuring that:

  • you have the necessary rights and permissions to provide Customer Data to PestRouting;
  • your use of PestRouting complies with applicable laws;
  • your Customer Data is accurate, lawful and suitable for the intended processing;
  • you have informed relevant persons where legally required;
  • you have a valid legal basis for providing personal data to us where required;
  • you do not provide sensitive or special categories of personal data unless expressly agreed with us.

15. FieldRoutes and Other Third-Party Integrations

PestRouting may connect to third-party systems, including FieldRoutes and other field service, CRM, scheduling, calendar, payment, analytics or operational systems.

You are responsible for:

  • obtaining and maintaining the necessary third-party accounts;
  • authorizing the integration;
  • ensuring that you are allowed to connect the third-party system to PestRouting;
  • ensuring that the data retrieved from such systems may be processed by PestRouting;
  • complying with the third-party provider’s terms and policies;
  • maintaining the accuracy and availability of data in third-party systems.

We are not responsible for third-party systems, API availability, API changes, third-party data quality, outages, limitations or errors caused by third-party services.

We may suspend or modify integrations if required for security, legal, technical or operational reasons.

16. FieldRoutes Data Categories

Through your connected FieldRoutes account, PestRouting may access, import, process and store the following categories of data:

  • customer and service-location data, including customer names, service addresses, contact details and customer flags;
  • appointment data, including scheduled and completed appointments, dates, status and technician assignments;
  • subscription data, including recurring service agreements, service frequencies, contract details and cancellation reasons;
  • employee data, including technician and office-staff records, roles, active status and, where enabled, commission data;
  • office data, including branch and office locations;
  • route data, including planned and completed routes and assigned technicians;
  • appointment-slot or spot data, including time slots associated with routes;
  • service-type data, including service definitions and associated service durations;
  • skill data, including technician qualifications.

The exact data categories may depend on your configuration, enabled features, FieldRoutes permissions, API availability and future product development.

17. Integration Tokens and API Credentials

Where necessary to provide the Service, we may store API keys, access tokens, refresh tokens or similar credentials for FieldRoutes or other integrations for the duration of your use of the relevant integration.

You authorize us to store and use such integration credentials to access, import, process, sync and, where enabled, write back data through the integration.

You are responsible for ensuring that the credentials and permissions you provide are valid, authorized and appropriate for the intended use.

You may revoke or disable integration access by changing the relevant settings in the third-party system, where available, or by contacting support.

If integration access is revoked, disabled, expired or invalid, certain features of PestRouting may no longer function.

18. Writing Data Back to FieldRoutes and Other Systems

Depending on your plan, configuration and enabled features, PestRouting may write data back to FieldRoutes or other connected third-party systems.

Such write-back actions may include, but are not limited to:

  • new route or scheduling suggestions;
  • changed routes;
  • technician assignments;
  • appointment dates and times;
  • route, appointment or scheduling updates;
  • other changes supported by the connected third-party system and enabled features.

You expressly authorize PestRouting to perform write-back actions where you enable, approve, trigger, configure or otherwise authorize such functionality.

You are responsible for reviewing and validating changes before applying them, unless you intentionally enable automated or scheduled execution.

Where automated or scheduled write-back features are enabled, you are responsible for the configuration, review processes, permissions and operational consequences of such automation.

We are not responsible for damages caused by inaccurate source data, incorrect configuration, unauthorized internal use, third-party API errors, FieldRoutes limitations, manual changes by your users, or your decision to apply or automate changes, except to the extent liability cannot be excluded under applicable law.

19. Data Protection

We process personal data in accordance with our Privacy Policy.

Where we process personal data on your behalf as a processor, such processing is governed by a separate Data Processing Agreement unless another valid data processing agreement has been concluded.

You are responsible for ensuring that you have a valid legal basis for providing personal data to PestRouting and for using the Service with your customer, employee, technician, office, route and appointment data.

20. Aggregated and Anonymized Data

We may use aggregated, anonymized or otherwise non-identifying data to operate, analyze, improve, secure and develop PestRouting and related services.

Such data will not identify you, your customers, your employees, your technicians or other individuals.

We do not use identifiable Customer Data for artificial intelligence model training unless separately agreed or unless our applicable terms and privacy documentation are updated accordingly.

21. Artificial Intelligence

As of the Last Updated date of these Terms, PestRouting does not process identifiable Customer Data through artificial intelligence APIs or use Customer Data in AI prompts.

If we introduce AI-powered features that process Customer Data, we will update the applicable product documentation, Privacy Policy, Data Processing Agreement or these Terms as required.

You should not submit Customer Data into any AI feature unless such feature is clearly provided and documented for that purpose.

22. Subprocessors and Third-Party Service Providers

We may use third-party service providers and subprocessors to provide, host, secure, monitor, analyze, support and improve PestRouting.

These may include hosting providers, database infrastructure, email providers, analytics providers, error monitoring providers, CRM providers, scheduling tools, payment providers, mapping and location services, security tools and other operational service providers.

Current service providers may include Hetzner, Hostinger, Resend, PostHog, HubSpot, Cal.com, Paddle, Sentry, Laravel Nightwatch, Google Maps / Google Places APIs and, if enabled in the future, Cloudflare.

FieldRoutes and other systems connected by the customer are generally customer-authorized third-party integrations rather than subprocessors controlled by us.

Details may be provided in our Privacy Policy, Data Processing Agreement or Subprocessors page.

23. Data Retention and Deletion

Customer Data may be retained for the duration of the subscription and as necessary to provide the Service.

After termination or expiry of the paid subscription, Customer Data will generally be deleted or anonymized within 90 days after the end of the paid subscription term, unless longer retention is required by law or necessary for legitimate legal, billing, tax, security, compliance or dispute-resolution purposes.

Backup copies, where applicable, may persist for a limited period and will be overwritten or deleted according to our backup and retention procedures.

You may contact support@pestrouting.com to request data export or deletion assistance. Export or deletion assistance may depend on technical feasibility, applicable law, security requirements, your plan and the applicable Data Processing Agreement.

24. Customer Responsibilities

You are responsible for:

  • your use of PestRouting;
  • your users and their actions;
  • your Customer Data;
  • your connected third-party systems;
  • your FieldRoutes permissions and integration settings;
  • reviewing and validating routing recommendations;
  • maintaining your own operational records and backups where appropriate;
  • complying with applicable laws and third-party terms;
  • obtaining all required rights, permissions, consents or legal bases;
  • ensuring that your users are authorized and trained to use the Service appropriately.

You must not rely on PestRouting as the sole source of truth for legally, financially, operationally or safety-critical decisions.

25. Acceptable Use

You may not use PestRouting to:

  • violate applicable laws or third-party rights;
  • upload or process unlawful, harmful, misleading or infringing content;
  • interfere with the security, integrity or availability of the Service;
  • reverse engineer, decompile or attempt to extract source code;
  • copy, resell, sublicense or make PestRouting available to third parties without permission;
  • use automated scraping, bots or excessive automated requests without permission;
  • bypass usage limits, security mechanisms, payment obligations or access restrictions;
  • use the Service for benchmarking or competitive analysis without our prior written consent;
  • upload malware, malicious code or harmful data;
  • process special categories of personal data unless expressly agreed with us.

We may suspend access if we reasonably believe that you or your users violate this section.

26. Support

Support is available via support@pestrouting.com unless another support channel is agreed.

Support is provided on a commercially reasonable best-effort basis unless a specific support level, response time or service level has been expressly agreed in writing or included in your plan.

We do not guarantee specific response times, resolution times or support availability unless expressly stated in the applicable plan or agreement.

The scope, response times and availability of support may depend on your plan, subscription, service package or agreement.

27. Availability, Maintenance and Changes

We aim to provide a reliable and useful Service.

However, we do not guarantee uninterrupted availability, error-free operation or permanent availability of all features.

We may temporarily restrict access for maintenance, updates, security reasons, infrastructure issues, third-party service interruptions, API changes, legal reasons or other operational reasons.

We may modify, improve, remove or replace features from time to time, provided this does not materially reduce the core functionality of a paid subscription without reasonable cause.

No uptime commitment, service credit or service level agreement applies unless expressly agreed in writing.

28. Security

We apply commercially reasonable technical and organizational measures designed to protect the Service and Customer Data.

However, no system can be guaranteed to be completely secure.

You are responsible for secure account management, user permissions, endpoint security, third-party account security, API credential management and ensuring that your users follow appropriate security practices.

You must promptly notify us if you become aware of unauthorized access, compromised credentials or a security incident affecting PestRouting or connected integrations.

29. Intellectual Property

PestRouting, including the software, algorithms, dashboards, designs, workflows, code, databases, documentation, brand elements, content and related materials, is owned by us or our licensors.

Except for the limited right to use PestRouting under these Terms, no rights are transferred to you.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer or create derivative works based on PestRouting unless expressly permitted by us in writing.

30. Customer Feedback

If you provide feedback, ideas, suggestions, bug reports, feature requests or recommendations, we may use them without restriction or compensation to improve PestRouting and our related products and services.

You confirm that such feedback does not contain confidential information unless explicitly agreed otherwise.

31. Marketing References

We may use your company name, logo, testimonials, case studies, results or other customer references for marketing purposes only with your prior consent.

Any detailed case study, public performance claim or testimonial will require separate approval.

32. Confidentiality

Both parties may receive confidential information from the other party.

Confidential information must be protected with reasonable care and may only be used for the purpose of performing or receiving the Service.

This does not apply to information that is publicly available, already known without confidentiality obligation, independently developed, or lawfully received from a third party.

33. Suspension

We may suspend access to PestRouting if:

  • payment is overdue or cannot be processed by Paddle;
  • there is a security risk;
  • you breach these Terms;
  • your use creates technical, legal or operational risks;
  • required by law, a competent authority or a third-party provider;
  • a third-party integration requires suspension;
  • we reasonably suspect unauthorized, fraudulent or abusive use.

Where reasonable, we will provide notice and an opportunity to resolve the issue.

34. Termination

You may stop using PestRouting at any time and may cancel your subscription according to the applicable cancellation process.

We may terminate or suspend access if you materially breach these Terms, fail to pay fees, misuse the Service, violate applicable laws or create material risk for us, our Service, Paddle, third-party providers or other customers.

Upon termination, your right to access PestRouting ends.

Customer Data may be retained, deleted, anonymized or exported according to these Terms, our Privacy Policy, the applicable Data Processing Agreement, legal obligations and technical retention procedures.

35. Limitation of Liability

Nothing in these Terms limits or excludes liability for intent, gross negligence, injury to life, body or health, mandatory statutory liability, liability under the German Product Liability Act, or any liability that cannot be limited or excluded under applicable law.

In cases of slight negligence, we are liable only for breaches of essential contractual obligations. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely.

In such cases, liability is limited to the foreseeable, typical damage.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or in connection with the Service is limited to the amount paid by you for the Service in the 12 months preceding the event giving rise to liability, excluding taxes.

To the maximum extent permitted by applicable law, we are not liable for indirect damages, lost profits, lost revenue, lost savings, loss of business opportunities, business interruption, reputational harm, loss of goodwill, consequential damages or damages caused by inaccurate Customer Data, third-party systems, third-party APIs, FieldRoutes errors, operational decisions, manual changes, external events, incomplete data or misuse of the Service.

The above limitations apply regardless of the legal basis of the claim.

36. Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, costs and expenses arising from:

  • your unlawful use of PestRouting;
  • your Customer Data;
  • your breach of these Terms;
  • your violation of third-party rights;
  • your misuse of third-party integrations;
  • your failure to obtain necessary rights, permissions, consents or legal bases;
  • your operational use of routing, scheduling or optimization outputs without appropriate review.

This does not apply to the extent a claim is caused by our own breach, intent or gross negligence.

37. Changes to these Terms

We may update these Terms from time to time.

If changes are material, we will make reasonable efforts to notify you, for example by email, in-app notice or website notice.

Material changes to these Terms will generally take effect no earlier than 30 days after notice to existing paid customers, unless earlier changes are required by law, security reasons, third-party requirements or urgent operational necessity.

If you do not agree to updated Terms, you must stop using the Service and cancel your subscription before the updated Terms take effect.

Continued use of PestRouting after the effective date of updated Terms constitutes acceptance of the updated Terms.

38. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.

If you are a merchant, legal entity under public law or special fund under public law, the courts competent for our registered office shall have jurisdiction, unless mandatory law provides otherwise.

Mandatory consumer protection rules, where applicable, remain unaffected.

Payment transactions processed by Paddle may additionally be subject to Paddle’s applicable buyer terms, payment terms and refund terms.
